Stitches - Terms of Service

1. Acceptance of Terms
By accessing or using the Stitches mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to
these Terms, do not use the App.
2. Description of Service
Stitches is a private social media platform that allows users to create groups, share daily photos and videos, and interact with content through
pins and comments. The service is provided "as is" and may be modified or discontinued at any time.
3. Eligibility
You must be at least 13 years old to use Stitches. By using the App, you represent and warrant that you meet this age requirement.
4. Account Registration
Account Creation
- You must provide accurate and complete information when creating an account
- You are responsible for maintaining the confidentiality of your password
- You are responsible for all activities that occur under your account
- You must notify us immediately of any unauthorized use of your account
Account Security
- Do not share your account credentials with others
- We are not liable for any loss or damage arising from your failure to protect your account information
5. Zero Tolerance Policy
Stitches has a ZERO TOLERANCE POLICY for objectionable content and abusive behavior. We are committed to maintaining a safe and respectful
environment for all users.
Objectionable Content
We will NOT tolerate any content that is:
- Pornographic, sexually explicit, or contains nudity
- Violent, graphic, or promotes harm to others
- Hateful, discriminatory, or promotes intolerance
- Harassing, threatening, or abusive
- Illegal or promotes illegal activities
Abusive Users
We will NOT tolerate users who:
- Harass, bully, or threaten other users
- Share others' private information without consent
- Engage in hate speech or discrimination
- Create fake accounts or impersonate others
- Repeatedly violate our community standards
User Reporting
All users have the ability to report objectionable content or abusive behavior. We will promptly investigate all reports and take appropriate
action, which may include:
- Immediate removal of violating content
- Suspension or permanent termination of user accounts
- Reporting illegal activity to law enforcement
By using Stitches, you acknowledge that violations of this Zero Tolerance Policy will result in immediate and permanent removal from the platform.
6. User Content
Your Content
- You retain ownership of all photos, videos, and other content you upload to Stitches
- By uploading content, you grant us a license to store, display, and transmit your content solely for the purpose of providing the service to
you and your group members
- You are solely responsible for the content you post
Content Restrictions
You agree not to upload content that:
- Violates any law or regulation
- Infringes on intellectual property rights of others
- Contains viruses, malware, or harmful code
- Is defamatory, obscene, pornographic, or sexually explicit
- Promotes violence, hatred, or discrimination
- Harasses, threatens, or intimidates others
- Contains private information of others without consent
- Is spam or unsolicited commercial content
7. Prohibited Conduct
You agree not to:
- Use the App for any illegal purpose
- Impersonate any person or entity
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the App or servers
- Reverse engineer, decompile, or disassemble any part of the App
- Use automated scripts or bots to access the App
- Collect or harvest information about other users
- Create multiple accounts or fake accounts
- Sell, transfer, or assign your account to others
8. Groups
Private Groups
- All groups on Stitches are private
- Only group members can view content shared within a group
- Group creators can manage membership and remove members
- You are responsible for the groups you create and the members you invite
Content Sharing
- Content you share in a group is visible to all group members
- We are not responsible for how group members use or share your content outside the App
- You should only join groups with people you trust
9. Intellectual Property
Our Rights
- Stitches, our logo, and all related trademarks are owned by us
- The App design, features, and functionality are protected by copyright and other intellectual property laws
- You may not copy, modify, or create derivative works based on our App
10. Third-Party Services
The App uses third-party services (such as Cloudinary for media storage). Your use of these services is subject to their respective terms of
service and privacy policies. We are not responsible for third-party services.
11. Termination
By You
You may delete your account at any time through the App settings.
By Us
We reserve the right to suspend or terminate your account at any time, with or without notice, for:
- Violation of these Terms
- Fraudulent, abusive, or illegal activity
- Extended periods of inactivity
- Any reason we deem appropriate
Effect of Termination
Upon termination:
- Your right to use the App will immediately cease
- We may delete your account and content within 30 days
- Sections of these Terms that by their nature should survive will remain in effect
12. Disclaimers
AS-IS Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
No Guarantee
We do not guarantee that:
- The App will be uninterrupted, secure, or error-free
- Defects will be corrected
- The App is free from viruses or harmful components
- Results obtained from using the App will be accurate or reliable
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE ARE NOT LIABLE FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL
- OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY), WHICHEVER IS GREATER
14. Indemnification
You agree to indemnify, defend, and hold harmless Stitches and its officers, directors, employees, and agents from any claims, liabilities,
damages, losses, and expenses (including legal fees) arising from:
- Your use of the App
- Your content
- Your violation of these Terms
- Your violation of any rights of another party
15. Dispute Resolution
Governing Law
These Terms are governed by the laws of [Your State/Country], without regard to conflict of law principles.
Arbitration
Any dispute arising from these Terms or the App shall be resolved through binding arbitration in accordance with the rules of [Arbitration
Organization], except that you may bring claims in small claims court if they qualify.
Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions or class arbitrations.
16. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms in the App
- Updating the "Last Updated" date
- Sending you a notification (if applicable)
Your continued use of the App after changes constitutes acceptance of the new Terms.
17. General Provisions
Entire Agreement
These Terms constitute the entire agreement between you and Stitches regarding the App.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
